Businesses and the Corporate Manslaughter Act

All companies need to be aware of the implications of the recent Corporate Manslaughter and Corporate Homicide Act 2007 which came into force on the 6 April 2008 and affects the way all businesses manage health and safety within their company.

Beware of employees using company vehicles
The new act focuses on the people within companies and not just individual directors. Companies face unlimited penalties if found guilty of “corporate manslaughter” and this legislation applies to all companies.  An example could be a fatal accident arising from a company's failure to ensure its employee’s cars are kept in a roadworthy condition, even where employees are using their own vehicles.
